關于統(tǒng)一化構建我國執(zhí)行體制的思考
摘 要
“執(zhí)行難”的成因是多方面的，但根本原因是在于執(zhí)行體制本身。我國現(xiàn)階段執(zhí)行體制的主要特征是執(zhí)行機構的獨立性不夠，沒有單獨的《強制執(zhí)行法》。其主要原因在于沒有認清執(zhí)行權的性質(zhì)。執(zhí)行權是1種綜合性的權力，所以執(zhí)行權也不能被審判權吸收，而應該制定單獨的《強制執(zhí)行法》，設置類似海關系統(tǒng)的垂直領導機構即執(zhí)行法院，統(tǒng)1行使執(zhí)行權。

Abstract
There are many causes for the difficulty in law enforcement, but the most fundamental one lies in the system of law enforcement itself. In our country, the current enforcement system is mainly featured with the inadequate independance of law enforcement institutions, and there is no separate "law of compulsory enforcement". The main reason for this is because the nature of enforcement power is not clearly understood. The law enforcement power is a comprehensive power, thus should not be included in jurisdiction power, but be clearly divided from jurisdiction by formulating a separate "law of compulsory enforcement". And a vertical enforcement structure, similar to the structure of customs, must be set up, to exert exclusively the power of law enforcement.
