論土地承包經(jīng)營權(quán)入股
摘要
土地承包經(jīng)營權(quán)入股是指土地承包方之間為發(fā)展農(nóng)業(yè)經(jīng)濟(jì)將承包期內(nèi)的'土地承包經(jīng)營權(quán)量化成股份,以入股形式與他人自愿聯(lián)合從事農(nóng)業(yè)生產(chǎn)合作,并按股取得收益的1種流轉(zhuǎn)方式。經(jīng)過10多年的發(fā)展,它在實踐上仍存在土地權(quán)利結(jié)構(gòu)變化、股權(quán)轉(zhuǎn)移、法律環(huán)境等方面的問題,因此通過改革土地產(chǎn)權(quán)制度、以市場中介推動股權(quán)轉(zhuǎn)移、在立法上適當(dāng)放寬對土地用途的管制是10分必要的。

Abstract
The operating right of land contracting buys stock is a way of the circulation, that is quantification the operating right of land contracting between the land contracting side in the contracting time, and is doing cooperative production of agricultural voluntarily, and obtains with stock.
After the development of more then ten years , it still exists some malpractices such as right structural of land changing、stock shifting、and legal environment and so on, so it’s essential to innovate the system of property right of land、to drive the stock shifting、and to let out the control with land using on legislation appropriately.
