論我國(guó)反壟斷執(zhí)法機(jī)構(gòu)的設(shè)置

摘 要

制定反壟斷法，其目的是為了反對(duì)壟斷和限制競(jìng)爭(zhēng)，旨在維護(hù)市場(chǎng)競(jìng)爭(zhēng)秩序，營(yíng)造1個(gè)公平有序的市場(chǎng)環(huán)境。然而，反壟斷法本身并不能創(chuàng)造1個(gè)自由、公平的交易環(huán)境，其有效實(shí)施必須借助于1個(gè)有效的反壟斷執(zhí)法機(jī)構(gòu)。在中國(guó)的反壟斷法呼之欲出的今天，預(yù)先設(shè)計(jì)1個(gè)合理的反壟斷執(zhí)法機(jī)構(gòu)，對(duì)于保障我國(guó)未來(lái)反壟斷法的有效實(shí)施有著尤為重要的作用。

Abstract

The purpose of enacting the PRC Anti-trust Law is to fight against monopoly and restriction on competition, maintain the order of competition in the marketplace and create a fair and disciplined market environment.  However, the Anti-trust Law itself cannot create a business environment that is free and fair.  The Anti-trust Law may be effectively implemented only when effective enforcement agencies are established.  At this time when the PRC Anti-trust Law will soon be promulgated, establishing reasonable enforcement agencies for the enforcement of this law will have significant effects to ensure that the to-be-promulgated PRC Anti-trust Law will be effectively implemented and enforced.
